This CLE course will provide counsel with techniques for identifying and presenting key issues for appeal. The panel will cover effective drafting of the questions presented and provide case-winning tips for preparing a strong appellate brief.

Description

Appellate counsel should select the issues to pursue on appeal with the standards of review in mind. It is important to identify the issues that have the best chance of success at the appellate level and to limit the number of overall issues that will be raised.

Formulating the questions presented is one of the most critical tasks of writing the appellate brief. The questions should be drafted clearly and succinctly in a way that sets out the strongest arguments on appeal.

Good choice and framing of the issues create the base on which counsel can generate a strong brief and oral argument to focus the panel on the key points and most persuasive arguments favoring his position in the appeal.
