Description

Property owners can be liable for catastrophic injuries caused by others or caused by conditions created by others about which the owner/occupier may claim ignorance or deny responsibility. But in 2022, both the severity of injuries and the amount of verdicts increased dramatically.

Many complex legal and factual issues arise in these types of cases, including which of many different defendants may be responsible for the injury and their relative fault. Sometimes the work of a third party can change the premises, or sometimes employees fail to disclose relevant information to the property owner/occupier. Both the identity of the defendant and the purpose of going onto the property can affect the analysis, claims, defenses, and insurance coverage.
