This CLE course will address environmental law issues impacting the cannabis industry. The panel will discuss ongoing state agency enforcement actions, private litigation, and state law such as California's Prop 65. The panel will discuss myriad environmental regulations--including those for pesticides, water, and air--and best practices for addressing compliance and minimizing environmental risks.

The expansion of the legal status of cannabis nationwide has positioned the industry for massive growth and fueled a surge in cannabis-related business opportunities. But the division between state and federal status makes it difficult to navigate the many environmental law issues facing the industry.

Cannabis, hemp, and CBD related businesses and their vendors face many environmental-related risks and issues. From water law compliance for cannabis cultivators to air quality issues for manufacturers to product warnings, the environmental regulatory landscape continues to evolve and impact cannabis related businesses throughout the supply chain. In addition to government regulation, private litigation against these businesses involving environmental issues continues to grow, including toxic tort and product liability claims, as well as odor-based nuisance claims.
