This CLE webinar will guide patent counsel on the new EU Unitary Patent System and the Unified Patent Court (UPC). The panel will discuss the key considerations for counsel when determining whether to file in the national courts or in the UPC, and if in the UPC, in which division to file. The panel will discuss the pros and cons of the different options and offer advice on best practices for selecting a forum or multiple fora (forums) within or outside the UPC.

Institution of the Unified Patent Court (UPC) in June 2023 brings more forum options from which patentees can choose to bring patent infringement actions in the EU.

One of the big advantages of the UPC is the possibility to have one judgment in a single court proceeding that can then be enforced in many jurisdictions. A single proceeding should mean lower costs and a shorter time compared to being involved in several matters in multiple jurisdictions. However, this also means that one judgment can nullify a patent in multiple jurisdictions.

Further, not all EU member states participate in the UPC system. As a result, litigation in the national courts may be the necessary option against certain infringers. It is critical for litigants to weigh the pros and cons before filing.
