Description

Patent law is a part of intellectual property law that provides protection for innovation. Patent law governs the patent application process and provides the statutory requirements. It also defines the limit of what can be patented. There are utility and design patents.

To qualify for a utility patent, an invention must be patentable subject matter, useful, novel, and nonobvious. A patent grants the right to exclude others from making, using, or selling the invention and the right to sue infringers. Patent claims detail the parts of the invention to be protected.
