This CLE webinar will discuss from a policyholder’s perspective the flood of major liability challenges and complex coverage issues arising from plastics litigation. The panel will offer to coverage and litigation counsel insight into the nature of claims being asserted and the types of defendants who are targets. The panel also will offer a policyholder side perspective on arguments supporting insurance coverage and challenges faced in obtaining coverage under various types of policies, the likelihood of coverage being found, and why.

Description

Companies are increasingly being sued for contributing to "plastic pollution," particularly with respect to microplastics. Plaintiffs have targeted entities that directly sell handle or dispose of microplastics, but also those that design or sell products containing them or companies that tout the recyclability of their plastic-containing products. Claims have alleged a wide range of harms and been based on several theories: citizen suit, consumer protection and greenwashing, public nuisance, securities law violations, and more.

Plaintiffs face significant challenges not the least of which is the absence of any standardized or reliable method for identifying or detecting microplastics. Depending on the nature of the claim and damages alleged, several different types of insurance policies could potentially offer coverage to defend or indemnify companies, such as pollution policies, property insurance, E&O, D&O, and commercial general liability policies (CGL).

Finding coverage may present several challenges including whether the harm was expected or intended, coverage triggers, and the number of occurrences. Policyholders may also have to contend with exclusions, such as for pollution, and allocation among policies over multiple years.
