This CLE course will provide renewable energy attorneys with an in-depth analysis of state regulatory challenges for renewable energy projects and facilities. The panel will discuss recently enacted legislation from various states on energy standards, siting, permitting, transmission, and rate structures. The panel will also provide best practices for structuring transactions and navigating project construction, operations, and maintenance to meet state regulatory standards.

Description

Many policies that advance the growth of renewable energy are established at the state level. However, meeting state regulatory standards presents some challenges for renewable energy projects.

States have been active in revising their renewable portfolio standards (RPS) to diversify their energy resources, promote energy production, and increase economic development. These state standards and associated regulations typically set requirements for the siting, permitting, construction, transmission, and operations for renewable facilities.

Recently, Washington adopted the Clean Energy Transformation Act, which mandates an emissions-free electric grid by 2045. New York adopted the Accelerated Renewable Energy Growth and Community Benefit Act, which revamps the process under which renewable energy facilities and associated transmission lines receive state and local approvals. Other states, such as Virginia, Illinois, and California, have made similar strides in enacting regulations specifically focused on the advancement of renewables.

Energy attorneys must carefully monitor various state regulations when structuring transactions and navigating challenges stemming from project construction, operations, and maintenance.
