This CLE course will closely examine the 2021 ALTA/NSPS Standards and examine noteworthy recent developments related to these standards. The panel will also discuss how title insurers typically address various survey matters in title policies and the utility of survey endorsements.

Description

Land surveys are primary due diligence tools in real estate transactions or development deals. They depict location, boundary, and topography, with a description of improvements, encumbrances, and other observations.

The most recent survey standards are the 2021 Minimum Standard Detail Requirements for ALTA/NSPS Land Title Surveys (the Standards). Practitioners must understand these Standards (including Table A) to ensure surveys are correctly prepared.

Surveys can reveal significant title matters, which may appear as exceptions to title coverage. Counsel must address survey issues with the title company (and purchasers and lenders) and know which survey or other endorsements can resolve survey matters.
