The UPC opened for business in June 2023. The creation of the UPC is the most significant change in European patent litigation landscape in 50 years. Since the start of operations on June 1, the court has received over 340 cases through the end of April 2024. It is important to look at emerging trends and what can be learned from the key decisions of the court in the first year.

The UPC is an attractive forum because it has a broad reach and can decide preliminary injunctions as well as first and second instance decisions in a timely manner. The UPC also allows for forum shopping. For example, more infringement actions are being filed in Germany, which is known as one of the best patent litigation venues.

Things continue to develop at the UPC, and questions remain. It is important for patent holders and challengers alike to understand how things have evolved at the UPC over its first year and what lessons can be learned.
